10.4 Vending Machines

Pop and candy/snack vending machines are closed during lunch periods. (Exception: the senior high school students may have access to pop and candy/snack machines during the school day).

Neither pop nor candy/snack item vending machines should be available to elementary students.

It is the policy of the Board of Education to contract for the right to advertise, market and sell soft drinks and snack products at District facilities on an exclusive and District-wide basis. Employees and students are prohibited from engaging in any activity which would compete with, infringe upon or otherwise impair the Board’s grant of exclusive rights to advertise, market and vend soft drink and snack items on facilities owned, leased or operated by the District. Prohibited activities include, but are not limited to, advertising or sales of products or brands which compete with the product line of the vending contractor.

The operation, maintenance, servicing and location of vending machines at District facilities will be controlled by the specific terms and conditions contained in the District’s exclusive vending agreement. The initial location and configuration and any relocation of vending machines at school sites will be subject to the approval of the school principal or site administrator, which approval shall not be unreasonably withheld or delayed.

All proceeds derived from the District’s exclusive vending agreement will be paid to the Chief Financial Officer of the District for deposit and disbursement in accordance with the guidelines set forth in this policy and as may be directed from time to time by written resolution of the Board of Education. It is policy of the Board of Education that each school in the District receive, by way of a distribution to that school’s School Activity Fund, sufficient revenue from commission sales to equal or exceed revenues generated under previous vending arrangements.

All revenue generated from commissions on sales of soft drinks and snacks are deemed "concession sales" and as such, under the authority of Okla. Stat. tit. 70, ss 5-129(b) (3), such revenue shall be deposited into the Administrative office Activity Fund/Pepsi Vending Sub-Account for further transfer and disbursement in accordance with the provisions of Policy No. 10.1 -Activity Fund Accounting and Expenditure Procedures.
